In less than 40 words he had summed up 15 years of my research and investigative work. The Holy Grail of taxpayer dollars and Government fraud. The Ballew Syndrome!
GOVERNMENT MISCONDUCT
This was not an error, an omission, or even a simple mistake. It is the Government insiders' scandal of scandals and makes today's corporate accounting ethics headlines look trivial and amateurish. It is the most important policy, capitalism, and financial scandal of our lives. We must collectively take action to spotlight this hidden draining of our taxes. More importantly, we must expose the known, defective nature of the many defense systems that these government misfits are sending our soldiers "off to war" in. The corporations will take care of themselves. We must take care of each other. It is very simple to a simple man like me. When you directly or indirectly give aid to our enemies by what ever means, it's treason. If you kill any member of my friends or family because of your government employee or corporate greed, we will meet each other sometime.
SAME OLD STORY... BUT A NEW BILLION DOLLAR TWIST
Use it or lose it is and has always been the dominant rule when inept Government Agencies, the FBI, the Congress, the Courts, and the DOJ get together and, knowingly, "DON'T" do their jobs. When fraud is committed against our Government, it is our money and our lives at stake.
And then we discover the fox in the hen house.
These government employees could and should be referred to as the bad apples when their collective mission is to "hide it" and "shoot the messenger" when this illustrious team gets in a bind. The Ballew Syndrome is my name for identifying this easily recognizable and laughable bull "manure".
MAIN JUSTICE'S THREE CARD MONTE
It seems that the FBI and DOJ, along with the various government agencies they represent in court, do this same "Three Card Monte" on the taxpayers over and over, all over the country.
Congress knew they would try this and even clearly stated their Congression intent while originally drafting the law. Did you understand that. Congress clearly stated that the DOJ could not play the games they are playing. The red line in this linked chart below shows exactly how they do it. It eliminates the "checks and balances" built into our government. It is the Ballew Syndrome.
When repetitive fraud and bulldozers full of taxdollars are involved, mountains of mistakes are minimized, berms of beauracracy are built, dens of deceipt are devised, and buckets of bull "manure" are spread. Strong laws are already in place to handle this when it is done by either a government employee or a member of the Armed Services. These government employees are covertly diverting our tax dollars from the U.S. Treasury's General Account in massive amounts. You should call the Secretary of the Treasury and insist that the job is done and the crooks are prosecuted. You should also contact your Congressional representatives and let them know how you feel about this.
When government actions result in a financial loss it is a "taking" of property which demands compensation. U.S. v. Causby, 328 US 256, 90 Led2d 1206, 66 Sct 1062(1946)
MY CONFLICT OF INTEREST
Please understand both of my motives. I'll state them clearly and openly. I'm certainly not sure which motive is stronger, but I believe it is the same as yours would be.
First, understand that I am a proud citizen of my United States and it is my obligation and my job to try to help repair it when any part of my government is broken. This is called "citizenship".
Second, I'm a Texas red-neck and when someone steals from me, I want justice, and if the truth was told, some measure of revenge. (I never said I was a good person.)
I've already received all the apologies I can stand; some were obtained through strength of research and some by legal force. A long time ago I was considered to be one of the best technical researchers in the world and regularly sat across the table from some of the CEO's of the largest defense industry entities in the world. I am and was a reasonable person with an average background. International media and wire services even confirmed my reputation.
Read and decide for yourself. I'm certainly not a lawyer or CPA, but that doesn't mean I can't research, read and think for myself. Read and think for yourself. I'll try to tell you the truth and show you the documents involved. Remember, your citizenship is not free. You must work as hard here to preserve our freedom and laws as our servicemen must in dangerous and hostile locations.
Do your job, too.
LEAVE A TIP... BUT WALK THE CHECK
I received more money in settlement of a "fraud on the government" lawsuit that I ever expected. Then, I found out that the government attorneys had "left the tip and walked the check." I decided that I wanted justice from the Justice Department. What a joke. The only fair and non-threatening method was a return to their turf, the District Courts.
How many businessmen do you know that are mean enough (or determined enough) to file a federal lawsuit against the U.S. Department of Justice attorneys for "fraud on the (U.S. District) court by officers of the court."
I fought the Department of Justice all the way to the Supreme Court and you can guess the rest. None of the Courts said we were wrong, just too late. Imagine that.
Your would certainly be dumb to go into court without documented proof in any lawsuit. You're even dumber if you think the FBI, DOJ, or any other government agency is going to provide it from their files. It took me 9 years to gather the pieces to the puzzle and the documents to prove what I had initially claimed. I fought them on their turf, lost temporarily, and have exhausted my legal remedies.
Now, it's up to you. So this internet journalism is my closure on this matter. Either it will be a catalyst or not.
NEVER TRUST OUR GOVERNMENT AGENCIES
My only advice, after ten years of being on the same side as the Justice Department, is never co-operate or trust or expect honesty from the government agencies. Especially certain law enforcement branches in Washington or Dallas, Texas. (Remember the Dallas FBI office's lost documents in the McVea murder trial. I wanted him punished as much as anyone, but I wanted it done correctly and within the law.) The very same FBI office was responsible for handling my disclosure and claim files.
You guessed it. The government destroyed my files proving what I disclosed and claimed but I recorded the FBI's admissions regarding my formal and written disclosures to them about the Ballew Syndrome. They sent me a letter saying they found my FOIA requested files and then sent me a letter saying they had been destroyed under a policy that conflicts with the law. Go figure...
Let me restate this so there can't be any misunderstanding. The term "whistle - blower" is not in the False Claims Act or fraud law. It is a term of dirision to indicate that a person is "not a team player" or "one of the boys." Can you name one instance where the term is complimentary. It's not even a compliment to a football referee.
DOJ, FBI AND AGENCY MISMANAGEMENT
The term "whistle - blower" is only used when the government lawyers and the defrauded agency do not prevent, detect, or stop the fraud themselves. That is when government employees should be fired for not doing their jobs. They know what bad things that could happen to them if and when Congress finds out.
Their sick line of self-serving thoughts immediately discounts the value of experienced, hard-nosed, Quality Assurance Inspectors, the no-nonsense contract administrators, and many other reputable people that have interrupted criminal fraud against the government. They repeatedly try to shift the blame and coverup their mismanagement and ineptness. They should be fired, or worse...
And now, when documented proof of government misconduct is delivered to the FBI, accusing the DOJ, all of the files are destroyed. To a red-neck, there are history based solutions, that are, unfortunately, no longer acceptable. Fortunately, we have enough jails to hold them, when and if we can get the Courts to convict them. We need some TV sound-bites of their arrest and indictment.
Finally, remember that when I lost my 15% of the "proceeds of the action or settlement of the claim", you lost the other 85%. And this is being repeated more than you would believe.
CONCLUSION
Our national defense and personal safety is critically threatened when defective hardware, software, or services are covered-up by senior government lawyers and career agency employees in misguided attempts to maintain unfettered control of out-of-control programs and large budgets. This steals taxpayers dollars and gives aid to our country's enemies by perpetuating the unknowing use of defective weapon systems and everyday services. How can they send our service men and women into battle in these defective systems, knowing what they know. In the Old West, history tells us that outlaws that stole horses or sold diseased cattle were hung when caught.
